Agreement to Terms

By accessing or using Chahiya's website (chahiya.com), applications (app.chahiya.com), or any associated services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use our services. Chahiya is an all-in-one software-as-a-service (SaaS) platform for restaurant management, online ordering, and point of sale, operated by an independent software developer trading as Chahiya.

Description of Service

Chahiya provides cloud software allowing restaurant owners, cafes, and food creators ("tenants") to operate online ordering websites, digital QR table menus, counter point-of-sale (POS) registers, kitchen display screens (KDS), and automated menu tools. Chahiya is a technology provider: we are not a food delivery marketplace or party to transactions between tenants and their end customers.

User Accounts & Authentication

Chahiya supports four distinct user roles across its software ecosystem: (a) Restaurant Owners/Tenants who hold the primary subscription and administrative control via the Chahiya Dashboard; (b) Authorized Staff and Managers who operate the dashboard, point-of-sale (POS) terminals, or kitchen display systems (KDS) via invitations or PIN credentials; (c) Delivery Drivers who utilize the Chahiya Driver mobile application to receive and fulfill delivery orders; and (d) End Customers/Diners who view menus and place food orders via the Chahiya Customer PWA or table QR codes. Restaurant Tenants are strictly and vicariously liable for all activities, order modifications, voids, cash transactions, and data access conducted by their authorized staff, PIN credentials, or paired devices. You must be at least eighteen (18) years of age or the age of legal majority in your jurisdiction to create a restaurant tenant account, subscribe to paid plans, or register as a delivery driver. You are responsible for safeguarding your login credentials and PINs.

Acceptable Use Policy & Prohibited Items

Chahiya is designed exclusively for lawful, legitimate food, beverage, and hospitality businesses. You agree to use the platform in strict compliance with all applicable local, national, and international laws.

  • Absolute Alcohol Ban: Chahiya is strictly an alcohol-free platform. You are explicitly prohibited from using Chahiya to list, advertise, sell, or deliver alcoholic beverages, spirits, wine, beer, or any intoxicating liquor under any circumstances, regardless of local municipal licensing.
  • Strict Prohibition of Illicit Substances: You are strictly prohibited from using Chahiya to sell, advertise, facilitate, or distribute illegal drugs, narcotics, prescription pharmaceuticals, controlled substances, drug paraphernalia, firearms, weapons, explosive materials, adult services, stolen goods, or any unlawful products or contraband.
  • Immediate Account Termination: Chahiya maintains a zero-tolerance policy for prohibited items and illegal activities. We reserve the absolute right to immediately suspend, terminate, and delete any store, tenant account, or catalog offering alcohol, illicit substances, or items violating criminal laws, without prior notice, liability, or refund.
  • Cooperation with Law Enforcement: Chahiya reserves the right to report unlawful activities to relevant police and law enforcement authorities and provide necessary system audit logs and registration records when legally required.
  • Platform Non-Liability: As a technology infrastructure provider, Chahiya does not pre-screen or physically inspect merchant inventory. Chahiya disclaims all liability for unauthorized, prohibited, or illegal products offered by independent store operators.

Subscription Billing & Merchant of Record

Access to Chahiya's platform is provided on a flat-fee subscription basis (monthly or annual plans).

  • Merchant of Record (Paddle): For all international customers, our order process is conducted by our online reseller and Merchant of Record, Paddle.com (Paddle.com Market Limited / Paddle Payments Limited). Paddle handles payment processing, currency conversions, billing inquiries, and sales tax/VAT remittance.
  • Domestic Payments (Chargily): For customers in Algeria, payments in Algerian Dinars (DZD) are processed via Chargily Pay V2.
  • 0% Commission: Chahiya does not take a percentage or transaction commission on orders placed by your restaurant customers.
  • Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date.

Free Trial & Cancellation

We offer card-free free trials (14 days for restaurants, 30 days for individual creators) so you can explore the platform with zero risk. You may cancel your paid subscription at any time directly through your dashboard settings or through the Paddle customer portal. Upon cancellation, you retain full access to your plan until the conclusion of your current prepaid billing period.

Tenant Responsibilities & Data Ownership

You retain full ownership of all content, menus, customer lists, order histories, and branding you upload to Chahiya. As a tenant, you are responsible for:

  • The accuracy of your menu items, pricing, allergen warnings, and descriptions.
  • Compliance with local food handling, licensing, health, and consumer regulations in your jurisdiction.
  • Fulfilling orders and providing customer service directly to your diners.

User Content, Copyrights & Intellectual Property Warranty

You retain ownership of the content, menus, photographs, logos, and trademarks you upload to Chahiya. However, you are solely responsible for all content, images, and text you transmit, publish, or display on your storefront or dashboard.

  • Warranty of Ownership: You represent and warrant that you own all copyrights, trademarks, and intellectual property rights in any photos, graphics, logos, menu descriptions, and materials you upload, or that you have obtained all necessary licenses, permissions, and consents from the legal copyright holder.
  • Infringement Prohibition: You strictly agree not to upload, publish, or use any copyrighted photographs (including stock photos or images obtained from third-party websites, competitors, or search engines) without proper licensing or authorization.
  • Notice & Takedown: Chahiya respects intellectual property rights. If we receive a notice or claim alleging that any content on your storefront or account infringes a third party's copyright, trademark, or proprietary right, we reserve the right, at our sole discretion and without prior notice or liability, to immediately remove, disable access to, or delete the infringing material. Chahiya reserves the right to suspend or terminate accounts of repeat infringers.
  • Indemnification: You agree to defend, indemnify, and hold harmless Chahiya, its operator, and developers from and against any and all claims, liabilities, damages, losses, and legal expenses (including reasonable attorneys' fees) arising out of or related to any claim that content or photos uploaded by you infringe the copyright, trademark, privacy, or intellectual property rights of any third party.

Customer Food Orders & Relationship with Restaurants

When an end customer places an order through a restaurant's Chahiya storefront, Customer PWA, or table QR code:

  • Direct Transaction: Chahiya is a technology provider and is not a party to the food transaction. The contract for the preparation and sale of food and beverage is formed directly between the dining customer and the respective restaurant.
  • Menu Accuracy & Food Safety: The restaurant is solely responsible for item availability, accurate ingredient and allergen disclosures, food preparation, quality, packaging, and timely delivery.
  • Food Payments & Disputes: Payments for meals (whether cash on delivery, card, or direct restaurant payment) are collected by or on behalf of the restaurant. Any inquiries, cancellations, or refunds regarding food orders must be directed to the respective restaurant establishment.

Food Allergies, Health & Safety Disclaimer

Chahiya is strictly a software provider and does not prepare, handle, cook, inspect, package, or deliver food, drinks, or ingredients.

  • Restaurant Responsibility: Restaurant operators are solely and exclusively responsible for the preparation, quality, hygiene, and freshness of all food products, as well as the accurate disclosure of all ingredients, potential allergens, and dietary warnings on their digital menus.
  • Diner Responsibility: Diners with food allergies, intolerances, or specific medical dietary needs must notify the restaurant staff directly before placing or consuming any order.
  • Disclaimer of Health Liability: Chahiya disclaims all liability for any allergic reactions, illness, foodborne pathogens, injury, or adverse health consequences resulting from any food or beverage prepared, sold, or delivered by restaurants using the platform.

AI Tools & Automated Menu Import Disclaimer

Chahiya provides automated, multimodal artificial intelligence (AI) tools to assist restaurant owners in extracting menu items, prices, and categories from photographs or PDF documents.

  • Assistive Feature Only: AI menu extraction and optical character recognition (OCR) are provided strictly as assistive conveniences and are not guaranteed to be 100% accurate, complete, or error-free.
  • Mandatory Tenant Verification: Restaurant operators are contractually required to carefully inspect, review, and confirm the accuracy of all imported dish names, descriptions, prices, tax rates, and modifier options before publishing menus to live customers.
  • Pricing Non-Liability: Chahiya is not liable for any financial losses, pricing discrepancies, undercharges, or typographical errors resulting from automated AI data conversion.

Hardware, Receipt Printers & Local Network Disclaimer

Chahiya is a cloud-hosted web application that operates on third-party user devices and local network environments.

  • Third-Party Peripherals: You are responsible for providing and maintaining compatible operating devices (such as Android tablets, iPads, computers), local Wi-Fi or cellular connectivity, and peripherals (such as ESC/POS thermal receipt printers or cash drawers).
  • No Hardware Liability: Chahiya does not warrant that third-party hardware or local Bluetooth/network printing will operate without interruption. Chahiya is not liable for delayed, dropped, or unprinted orders caused by local hardware malfunctions, paper shortages, printer disconnects, or local telecommunications outages.

Delivery Operations & Driver Conduct

Chahiya provides software for dispatch management, driver routing, and delivery tracking, but does not provide delivery transportation, employ couriers, or act as a transportation network company.

  • Independent Delivery Relationship: All delivery operations, courier recruitment, driver remuneration, vehicle safety, traffic compliance, and order transportation are managed solely and independently by the restaurant operator or their contracted couriers. Drivers are not employees, agents, or subcontractors of Chahiya.
  • Driver Standards & Qualifications: Couriers operating the Chahiya Driver mobile application represent and warrant that they possess all required driver's licenses, vehicle registrations, and valid insurance mandated by applicable local laws. Couriers must obey all traffic laws, drive prudently, and refrain from manipulating the mobile application while operating a moving vehicle.
  • Telemetry & Location Integrity: The Chahiya Driver app transmits real-time GPS telemetry for dispatch and customer tracking. Drivers must maintain authentic GPS transmissions. Utilizing mock-location software, GPS spoofers, or emulator bypasses is strictly prohibited and constitutes grounds for immediate account suspension.
  • Cash on Delivery (COD) Fiduciary Handling: Drivers collecting cash on delivery act strictly as fiduciaries and agents of the respective restaurant. Chahiya never takes custody of physical cash and disclaims all liability for cash discrepancies, loss, theft, or settlement disputes between restaurants and couriers.
  • Non-Liability for Accidents: Chahiya disclaims all liability for road accidents, traffic violations, delivery delays, personal injuries, property damage, or unlawful conduct of delivery personnel.

Tax, VAT & Fiscal Compliance

Restaurant operators are solely and independently responsible for determining, calculating, collecting, reporting, and remitting all applicable local sales taxes, value-added taxes (VAT), hospitality levies, and fiscal duties to appropriate tax authorities, and for complying with all local cash register and fiscal receipt regulations in their jurisdiction.

Intellectual Property

Chahiya and its licensors retain all intellectual property rights in the platform, software, designs, logos, and documentation. You are granted a non-exclusive, non-transferable, revocable license to access and use the platform in accordance with your subscription tier.

Service Availability

We strive for 99.9% uptime. While we implement robust redundancy, we do not warrant that service will be uninterrupted or error-free. We perform routine maintenance during off-peak hours and will provide advance notice whenever practicable.

Force Majeure

Neither party shall be liable for any failure or delay in performance resulting from causes beyond reasonable control, including acts of God, natural disasters, telecommunications or internet backbone outages, major cloud infrastructure failures (e.g., Cloudflare, Google Cloud, AWS), power grid failures, government regulations, labor strikes, civil disturbances, or war.

Limitation of Liability

To the maximum extent permitted by applicable law, Chahiya's total aggregate liability arising out of or related to these terms shall be limited to the total fees paid by you to Chahiya during the three (3) months preceding the incident giving rise to liability. In no event shall Chahiya be liable for indirect, incidental, consequential, or punitive damages.

Modifications to Terms

We reserve the right to modify, amend, or update these Terms of Service at any time to reflect changes in our software features, operational practices, corporate structure, payment providers, or applicable legal and regulatory requirements. Whenever we make changes, we will update the "Last updated" date at the top of this page. For material changes that significantly affect your rights, subscription pricing, or billing obligations, we will provide reasonable advance notice via the email address associated with your account or through an in-app notification within your Chahiya Dashboard before the updated Terms take effect. Your continued access to or use of the platform after the revised Terms become effective constitutes your binding acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue use of the services and, if applicable, may cancel your subscription in accordance with our cancellation policy.

Assignment & Severability

Chahiya may freely assign, transfer, or delegate these Terms of Service, in whole or in part, along with all associated rights, obligations, and subscription agreements, without notice or user consent, in connection with any corporate incorporation, reorganization, restructuring, merger, sale of assets, or transfer to an affiliate or successor-in-interest. You may not assign or transfer any rights or obligations under these Terms without our prior written consent. If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall continue in full force and effect.
